GENERAL POWERS AND DUTIES:
Inland Wetlands Agency:
- To establish, change or repeal inland wetland regulations and boundaries of inland wetlands. Note that tidal wetlands are excluded from municipal regulation. See part 2, Section II.D of manual.
- To hear, consider and decide upon petitions for changes in the inland wetland regulations.
- To take appropriate actions to enforce the inland wetland regulations and conditions of permits.
Conservation Commission:
- The Commission must conduct research into the utilization and possible utilization of land areas of the municipality and may coordinate the activities of the unofficial bodies organized for similar purposes.
- The Commission must keep and index of all open areas, public or privately owned including wetlands, for the purpose of obtaining information on the proper use of such areas, and may from time to time recommend to the planning commission or, if none, the chief executive officer or legislative body of the municipality plans & programs for the development and use of such areas.
- The Commission may make recommendations to zoning & planning commissions, inland wetland agencies, and other municipal agencies on proposed land-use charges.
- The Commission may (with approval of the legislative body) acquire land and easements in the name of the municipality.
- The Commission may (with approval of the legislative body) promulgate rules & regulations, including but not limited to the establishment of reasonable charges for the use of land & easements, for any of its purposes.
- The Commission may supervise and manage municipal parks & open space, provided the entity otherwise responsible for such duties has delegated the authority to the commission.
- The Commission must keep records of its meetings & activities and make an annual report to the municipality.
- The Commission may receive gifts in the name of the municipality for any of its purposes and must administer such gifts for those purposes subject to the terms of the gift.
- The Commission may exchange information with the Commissioner of Environmental Protection.
- If the municipality so provides, a commission may apply for a state grant-in-aid of a program established to preserve the use of open space land or restrict it to conservation or recreation purposes. Any such application made by another agency must be approved by the Conservation Commission prior to submission.
